                              Minutes of the December 14, 2004 Meeting

The Town Council held their regular meeting on Tuesday, December 14, 2004 at 7:00 p.m. at the Municipal Building. The Pledge to the Flag was recited. Roll call was taken with council members James Hall, Tonya Smith and David Crane and our attorney Henry Antonini present. Larry Natalie arrived late and Norma Snedeker was absent.
  The minutes of the November meeting and financial report were approved with a motion by David and seconded by Jim. The motion carried by voice vote.
  Mr. Blackmore was present and advised that he was still working on the clean up. Jane Tyler advised that Swan's had not been cleaned and that there was trash stacked up across the back of the house. Henry advised that he was working on filing a lawsuit and would keep them informed.
  Brad Emmert from Timberland Construction discussed the drainage at 6th and Lincoln Streets. He advised that in order for him to install the dry well the Town would have to give him a letter relieving him of any further obligation concerning the water issues. The Council advised that they could not give him the requested letter. Lon Gardner from Hannum, Wagle and Cline advised that with additional engineering work it would be possible to tell if the one dry well would be sufficient to take care of the water. The approximate cost would be $1,500. After much discussion involving several people, Mr. Emmert advised that he would go ahead and install the dry well if the Council would assume the maintenance of the dry well.
  A motion was made by David to have Timberland install the dry well on the Town's easement and/or secure an easement from the property owners if needed and that the Town would be responsible for the maintenance of the dry well. Also that the Council would not relieve Timberland of any responsibility if the dry well is not sufficient. And that the Council would waive the no dig ordinance since the location is not close to any water lines. And that the Council would provide a letter to Timberland accepting responsibility for the maintenance of the dry well. The motion was seconded by Jim and carried by voice vote.
  A proposal from Hannum, Wagle and Cline for a water system hydraulic study was reviewed. A motion was made by David and seconded by Jim to accept the proposal. The motion carried by voice vote.
  Teresa advised that she had received information from Cinergy to move the poles in the middle of the parking lot. The ballpark figure is $1,000. The council requested Cinergy put together a more in depth estimate.
  Ordinance #2004-3, AN ORDINANCE ESTABLISHING THE TOWN OF FAIRVIEW PARK RAINY DAY FUND, was read once in its entirety and twice by title. A motion was made by Jim and seconded by David to pass said ordinance. The motion carried by voice vote.
  The year-end meeting was set for Thursday, December 30, at 7:00 p.m. at the Town Hall.
  Loretta and Steve Johnson are putting in a modular home on Geneva Hills Road and requested they be allowed to hook onto Fairview Water. They would have to hook into the private line of Bruce and Marcy Speth and get their permission. The Johnson's were incorrectly advised that they could not dig until after March 15, but since their property is not located within the town limits, the no dig ordinance would not apply to them. The Johnson's were advised of the misinformation.
  Leonard Akers requested the assistance of the Town Marshal with cat problems.
  Ann Wake presented handouts to the Council for their information on the National Kidney Foundation's junk vehicle program. The Council will review.
  Henry J. Antonini advised that he would be resigning as town attorney as of December 31, 2004. He has served as the Town's attorney for 29 years. He thanked the Council and commended them for a job well done.
  Rick Royal thanked Sue, Mary Kay, Teresa, John, Kenny and the Fire Department for helping him when needed.
  A motion was made by David and seconded by Jim to pay the Town claims in the amount of $17,133.29, the wastewater claims of $6,432.24 and the Water department claims in the amount of $44,300.48. The motion carried by voice vote.
  The meeting adjourned at 8:12 p.m. with a motion by David and seconded by Jim. The motion carried by voice vote.

                                   Minutes of the December 30,2004 Meeting

  The Town Council held their year-end meeting on Thursday, December 30, 2004 at 7:00 p.m. at the Municipal Building. Roll call was taken with council members Jim Hall, Larry Natalie, Tonya Smith and David Crane present. Council member Norma Snedeker was absent.
  Salary Ordinance 2004-4 was read once in its entirety and twice by title. A motion was made by Tonya and seconded by Jim to pass said Ordinance. The motion carried by voice vote.
  Transfer Resolution 2004-5 was read and a motion was made by Jim and seconded by Tonya to pass said resolution. The motion carried by voice vote.
  Encumbrances for 2004 were read and made a part of these minutes.
  A motion was made by Tonya and seconded by Jim to keep all present appointments and to appoint Henry L. Antonini as town attorney. The motion carried by voice vote.
  A motion was made by David and seconded by Jim to pay the Town claims in the amount of $3,852.18. The motion carried by voice vote.
  The meeting adjourned at 7:20 p.m. with a motion by Jim and seconded by David. The motion carried by voice votte.
