                  Minutes of the June 11, 2002 Meeting

  The Town Council held their regular meeting on Tuesday, June 11, 2002 at 6:30 p.m. at the Municipal Building. Roll call was taken with council members James Hall, Larry Natalie, Tonya Smith, David Crane and Norma Snedeker and Attorney Henry J. Antonini present.
  The minutes of the May meeting and financial report were approved with a motion by Tonya and seconded by David. The motion carried by voice vote.
  Brad Hay, Hannum, Wagle & Cline advised that all binder and #9 asphalt has been completed. The finish coat has been completed in section 1 with the exception of Towne Street. The finish coat will be started in Section 2. Lon Gardner presented an approved pay request for B & T. An inspection will be scheduled for the middle to end of next week and a punch list will be compiled. Grading of Railroad, First and Second Streets will be done and Lon will check if paving needs to be done between 3rd & 4th on Towne.
  Questions were asked about how it was determined where the sewer lines would be placed. Lon advised it was determined on project cost and system requirements. Mike Pierce was not notified of the blacktopping on 9 th Street and when he left his driveway his truck became covered with tar. He asked whom he needed to present the bill to for cleaning. Brad Hay will contact Scott Boyer to see Mr. Pierce.
   Richard Kelley advised there had been blacktop on Parke south of 1 Street that has not been replaced. Lon will check and add to punch list if needed.
   After requests, the following were granted a 30 day extension to hook on to the sewer: Phil Randolph, Jerry Klyaic, Lisa Price, Steve Reed, Jim Spendal, Larry Natalie, Fairview Park playground and town hall, Linda Martin, Gary Merrick, Nancy Moulton, Bob Morgan, Tom McLeish, Shawna Kendrick, Monty Hawkins, Bob Strickland, Joy Dust, Cory Ausdor, Tim Griffin, Gary Thomas, Ernest Minnett, Marsha Zucca, Robert Wright, Mike Carty and Tom Roberts. In order to be granted an extension a person needs to have a permit and contractor in place.
Jim Spendal was advised that present plans include paving Chestnut.
   Mick Mack, apartment owner asked about his meter situation. He was advised that we would have our rate consultant here at the next meeting to answer questions.
   Leonard Akers wanted to be on record as being concerned about the contractor's compaction process. He foresees problems with swells in the roads in 5 to 6 years. Some contractors are making gouges in the new pavement. Council members and inspectors have talked with contractors.
   Chuck Strobel advised that 2 homeowners did not use the proper gluing technique and 1 had the pipe in backwards, which was not realized until after inspection and could cause problems in the future. He also advised that consultant Allen Ash had told him that it appeared that 1 or more loads of septic waste had been dumped into the system. Chuck asked about a service agreement for the generator. Lon Gardner advised that the generator should still be under warranty and the agreement should not be needed. The # 1 blower had a broken seal and was leaking oil. The company picked up the part for repair.
    A motion was made by Tonya and seconded by Norma to begin the process for withdrawal from the Indiana Utility Regulatory Commission. All were in favor by a show of hands.
   Questions were raised about tap fees for property outside the town limits and property that had taps installed by B & T on empty lots. The subject was tabled until the rate consultant could be consulted.
    An executive session was set up for June 13, 2002 at 7:00 p.m. at the town hall to discuss evaluation of individual employees.
    Leonard Akers had a letter from the Indiana Department of Health outlining the procedure for abandoning septic tanks. He also questioned if Bowen was going to put a 1" seal on the blacktop pad as agreed in the December 2000 minutes. Lon will check
    Tonya Smith and Jim Moore reminded everyone that there will be a fish fry on June 21 from 4 to 8 p.m. sponsored by the Citizens Society for Fire Protection. Proceeds will go towards the purchase of a thermal imaging machine.
    The drainage problem at Washington and 3rd Streets was discussed. Eric advised the dry wells need to be cleaned out on a regular basis. Clinton will do it the first time, but would need to be contracted after that.
    The Police Log was turned in for May.
     A motion was made by Norma and seconded by David to pay the Town claims in the amount of $6,212.28, the wastewater claims of $258,872.42 and the Water Department claims in the amount of $24,347.16. The motion carried by voice vote.
     The meeting adjourned at 7:45 p.m. with a motion by David and seconded by Tonya. The motion carried by voice vote.

  The Town Council held an executive meeting on Thursday, June 13, 2002 at 7:00 p.m. at the Municipal Building. Roll call was taken with council members Jim Hall, Larry Natalie, Tonya Smith, David Crane and Norma Snedeker present.
The council discussed evaluation of individual employees.
The meeting adjourned at 8:30 p.m. with a motion by Tonya and seconded by Norma. The motion carried by voice vote.
