              Minutes of the April 14, 2009 Meeting
 
   The Town Council held their regular meeting on Tuesday, April 14, 2009 at 7:00 p.m. at the Municipal Building. The Pledge to the Flag was recited. Roll call was taken with council members James Hall, Larry Natalie, David Crane and Jim Moore and Attorney Henry L. Antonini present. Absent was council member Janet Troglio.
    Larry briefly outlined the reasons for the Council contemplating the withdrawal of the Town's water utility from the IURC and then opened the floor for any questions or comments. There were many questions and opinions expressed. Answers were provided by our attorney, Henry L. Antonini, our rate consultant, Pat Callahan, and the Council. Henry also advised of 3 ways to overturn a vote to be removed from the IURC.
   Ordinance 2009-2, REMOVAL OF WATER UTILITY FROM JURISDICTION OF THE INDIANA UTILITY REGULATORY COMMISSION, was read and a motion was made to pass said ordinance by David and seconded by Jim Hall. The motion carried by voice vote.
   Sue advised that she had received a proposal from White Construction on paving all the unpaved roadways in Fairview Park. The total cost is listed at $93,000. Larry received a proposal from Oaks Paving in the amount of $145,000.
   Sue advised that the restrooms at the park need to be replaced. She received a quote of $6,361.57 from Andy Thompson. She also stated that a volunteer crew from Eli Lilly will be at the park on May 18th to do painting and clean-up. The company has donated $200 to cover the cost of supplies.
   Bill Foster and Yvonne Layton requested the drainage ditch in front of their homes on Plum Street be cleaned out as it was causing damage to their driveways. Larry advised that the Town employees would look at the problem. And that if we can get a backhoe in to do the work that it would be done.
   Jim Hall is still working with Lubovich and Town employees for drainage work at 3rd and Washington Streets.
   Leonard passed out cds with all the Town minutes and ordinances from 1988 to present.
   A motion was made by Jim Moore and seconded by David to pay the Town claims in the amount of $12,633.25, the water department claims in the amount of $8,918.59 and the wastewater claims in the amount of $10,368.39. The motion carried by voice vote.
   The meeting adjourned at 9:10 p.m. with a motion by David and seconded by Jim Hall. The motion carried by voice vote.

        Minutes of the April 14, 2009 Executive Meeting

         The Town Council held an executive meeting on April 14, 2009 after the regular meeting adjourned at the town hall. Roll call was taken with council members Jim Hall, Larry Natalie, David Crane and Jim Moore present.
         The Council received information classified as confidential by state or federal statute. The governing body certifies that no subject matter was discussed in the executive session other than the subject matter specified in the public notice.
         The meeting adjourned at 9:40 p.m. with a motion by David and seconded by Jim Moore. The motion carried by voice vote.
